Privacy

AeroCoach adheres to the data protection principles of the UK Data Protection Act. The personal data that we hold is limited to that required to identify and authenticate you on the AeroCoach application.

If you have bought a product from us, and have used the Stripe payment platform, we hold your Stripe Customer Reference number. We do not hold any financial or credit card information - this is handled by Stripe. We also may hold invoice and delivery address details in our accounting records.

You can contact us using the appropriate form on the AeroCoach website if you have questions or concerns regarding the data we may hold about you. We hold personal data for at least as long as we provide services to you, and then for a period afterwards where we deem it necessary to continue to manage our relationship with you, and also to fulfil our regulatory obligations.

Flight Recorders

We supply flight recorders specifically to produce flight data suitable for later analysis of aerobatic manoeuvres in the AeroCoach application.

THE AEROCOACH FLIGHT RECORDER IS NOT APPROVED BY ANY AVIATION AUTHORITY. FITTING THIS DEVICE INTO AN AIRCRAFT IS SOLELY THE RESPONSIBILITY OF THE PILOT/OWNER/OPERATOR OF THE AIRCRAFT. AEROCOACH WILL ACCEPT NO LIABILITY FOR THE USE OF THIS DEVICE IN AN AIRCRAFT.

The AeroCoach flight recorder is a low-cost device compared to commercial, industrial flight recorders costing several thousands of pounds. One of the primary aims of AeroCoach is to make aerobatic flight analysis affordable, so our recommended devices cost less than £500. These inevitably have lower performance than high cost professional devices, but give acceptable performance.

What is Acceptable Performance? The inverted and unusual attitudes of Aerobatic flight can cause the GPS unit within flight recorders to lose contact with the GPS satellites. The AeroCoach flight recorder uses sophisticated sensor fusion and Kalman filter technology to predict the flight path from various sensors. However, there may be an occasional vertical 'Correction Step' in the flight path when the GPS signal is re-acquired. While this can be a little irritating when trying to create the perfect video, it rarely affects the analysis of flight manoeuvres.

Very occasionally, the sensors may become unstable causing the flight path to become erratic. The flight recorder will automatically reset when the GPS and other sensors have stabilised. Careful attention should be paid to the installation instructions for the best performance.

Licensing

When you purchase a subscription to AeroCoach, you are contracting that the software will be used by a single named person. Sharing of login credentials is not allowed. In particular, there are groups of people (such as syndicates and flying schools) who share a flight recorder between aircraft and group members. Each person in these groups must have a personal subscription to the AeroCoach system.

Stripe Payment Platform

Product purchases and subscriptions are initially ordered using the AeroCoach on-line shop, but the collection of payments and the management of any subscriptions are handled by the Stripe platform (https://stripe.com). AeroCoach holds no financial information about customers.

If you are logged into the AeroCoach system, the Stripe Customer Portal can be accessed via the AeroCoach “Shop” menu. The Customer Portal will allow you to view a history of your payments; amend data that Stripe hold on your account; and allow you to manage your subscription with AeroCoach.

Payments can be done in Pounds Sterling (GBP), Euros (EUR) or US Dollars (USD). The AeroCoach shop uses fixed GBP, EUR and USD costs for each product, but there may be other transaction costs when paying through the Stripe platform.

Subscriptions

There are two “Durations” for subscriptions (monthly and yearly) and multiple “Levels of Functionality” (Evaluation, Basic and Pro).

Once a subscription has been purchased, you are contracting to use the system for the subscribed length of time. You are able to cancel at any time and your next subscription payment will not be collected. AeroCoach will continue to provide the contracted service until the end of the subscription period.

If you downgrade the “Level of Functionality” on a subscription, then AeroCoach will continue to provide the contracted service until the end of the subscription period, at which time the next payment will be collected for the lower “Level of Functionality” and the new contracted service will begin.

If you upgrade the “Level of Functionality” on a subscription, then AeroCoach will immediately terminate the existing contracted service; give a pro-rata credit for the unused time on the existing subscription; take payment for the new subscription less the pro-rata credit and start a new contracted service at the higher “Level of Functionality”.

If you move from a yearly subscription to a monthly subscription, then AeroCoach will continue to provide the contracted service until the end of the subscription year. The next monthly payment will be collected at the end of the subscription year and then on subsequent months.

If you move from a monthly subscription to an annual subscription, then AeroCoach will immediately terminate the existing subscription; give a pro-rata credit for the unused time on the existing subscription; start a new annual subscription and take payment for the new annual subscription less the pro-rata credit.

Deliveries

The AeroCoach/Stripe system will inform you within a few hours that a payment has been made.

AeroCoach will update your account with the new functionality for a subscription as soon as practical, certainly within a few working days of payment. An email will be sent informing you of the change.

For physical goods, AeroCoach will inform you by email within a few days detailing the expected dispatch date.

Delivery will be made to the address specified by you. AeroCoach may use any method of delivery available to it. AeroCoach will use reasonable endeavours to meet delivery and/or performance estimates but in no circumstances shall it be liable to pay compensation for non-delivery, non-performance or late delivery or performance. Time for delivery and/or performance will not be of the essence. AeroCoach reserves the right to delay despatch for a number of reasons, including performing any necessary credit or anti-fraud checks or procedures or to ensure that payment has been received in cleared funds in full. Where despatch is delayed for such reasons AeroCoach will use reasonable endeavours to inform you.

UK deliveries will be sent by Post Office “tracked” parcel post - expect 2-3 days from the dispatch date.

International deliveries will be sent by UPS courier. The receiver of the package will be responsible for paying any Import Duty; Sales/IVA tax; and courier administration fees. Expect 5-10 days depending on the location and the customs procedures. A tracking reference will be available.

Returns

If you wish to return a product, please contact AeroCoach to obtain a returns authorisation. Goods must then be returned, at your risk and expense, and must be undamaged, in re-saleable condition. You are responsible for returning the Goods to AeroCoach and for providing proof of delivery of such return. Note that the return of Flight Recorders is subject to the “Satisfactory Performance” criteria above. Goods that are damaged or not in a re-saleable condition will be appraised by AeroCoach who will deduct an appropriate handling fee from the repayment amount.

Force Majeure

The Company shall not be liable to the Customer in any manner or be deemed to be in breach of these Conditions because of any delay in performing or any failure to perform any of the Company's obligations under this Contract if the delay or failure was due to any cause beyond the Company's reasonable control (which shall include, but not be limited to government actions, war, fire, explosion, flood, import or export regulations or embargoes, labour disputes or inability to obtain or a delay in obtaining supplies of Goods or labour). The Company may, at its option, delay the performance of, or cancel the whole or any part of a Contract.

Legal Construction

All Contracts shall be governed by and interpreted in accordance with English law and the Customer submits to the jurisdiction of the English Courts, but the Company may enforce such Contract in any court of competent jurisdiction.
